3. Incontestability and misstatement of age
In the event of non-disclosure or misstatement in the declarations of the policyholder and / or the insured, the insurer may not challenge the contract after one year has elapsed from the inception date, except in the case of wilful misconduct on the part of the policyholder and / or insured or in the case of misstatement of the insured's age if his or her true age, on the policy's inception date, was higher than the age limit stipulated therein.
In all other cases, if, as a result of the misstatement of age, the premium paid is less than that which would have been payable, the benefit paid by the insurer will be reduced proportionally to the premium collected. If, on the other hand, the premium paid is higher than that which would have been payable, the insurer will be obliged to reimburse the surplus paid premium without interest.
5. Effective date, duration and termination of the policy
